Code P0765 transmission will not shift out of first gear

Pending, car drove fine when I bought it then went to drive it one day and it won't shift out of first gear, pulled over pulled the code and I got this pending, cleared it and drove, still not shifting right. took it back and they checked out at Carmax it drove fine, told them to keep it until they figure it out. is it possible for me to fix this?

This is something that can be figured out but it is easier to use the transmission simulator laid out in this test. However, if it were me I would let them figure it out. Just be mindful that they are probably going to try to say there is nothing wrong and give it back due to the code being pending.

Here is the test that would need to be completed. The theory of operation is pretty good at describing what is going on. Let me know if you have questions.
