On March 18, 2023, right after the heavy storms we had here in Los Angeles, my car had taken in some water to the engine per what Rusnak BMW advised me. This caused a hydro lock, and in turn, a blown motor. I filed a claim with Mercury insurance which was declined.
Mercury eventually replied after 3 months stating in a documented email that she spoke with the expert and was able to secure the reason for the engine blowing. Lisa stated that it was due to a bad Fuel Pump Module; in which I questioned her; failure to the module will cause a fault code to the care computer which there were none and the safety mechanism to kick in, which is to shut off the engine. she stopped all communication.
After 4 months and a week or so, I received a letter from Mercury stating that they have declined my claim due to mechanical reasons and referenced parts of the contract that do not pertain to the situation at hand nor gave a direct reason as to what happened to the car and make a connection to the damage.
They sent out their expert after 4 months of being in an active garage bodyshop who determined that because there was no water in the engine and metal shavings in the oil filter, it was mechanical error. when I took the car to the BMW dealership, they were the ones who determined that it was a hydro lock and told me that it was due to water in the engine, which was advised to the Mercury adjuster by the dealer a few days after the incident, after that, they let the car sit for 4 months. I can only assume to let the water evaporate.
so, now that I am going to court over this, I need to have references and proof that what they are doing is fraud and or criminal. so my first question is..
If a connecting rod in an engine breaks while traveling on the freeway at speeds between 60-65 MPH, can metal shavings be found in the oil filter?
