If you are driving this car when the engine seizes, can you sustain a bodily injury?

Our technician failed to put oil in this car when it was serviced.
The driver said that the car jolted forward, causing her to sustain severe whip-lash, soft tissue injury.
I have been told that a car with an automatic transmission would stall and not jolt forward.

hard to give a definite yes or no but engine should just quit and car coast to stop. the steering would become hard and the brakes may not work either.
