once the tranny gets worm and i stop it does not want to go into drive right away but then it does.it drives and shifts right?

That could mean a fault with the valve body or there are pressure leakages inside the trans and a pressure test would be required to confirm.

The fluid looks like their is to much and smells.I think i am going to change fluid and make sure it has the right amount? What do yu think Thanks

Overfilling can result in transmission error as the churning internally can create foaming of fluids. you can try reducing the fluid level but don't put too much hope on the fluid replacement solving the problem. Be prepare for the worst.
